The embezzlement was carried out by the debt collector for Article 374 of the Criminal Code. One of the cases carried out by the debt collector was embezzlement of the Mitra Dhana Ceswara People's Credit Bank loan in Lamongan. Problem formulation 1) What is the application of punishment for embezzlement carried out by a debt collector of bank funds in case No: 104 / Pid.B / 2014 / PN.Lmg) 2) What is the view of the judge in filing a decision on embezzlement committed by a debt collector on bank bank funds in case No: 104 / Pid.B / 2014 / PN.Lmg). This study uses a normative juridical approach. Data which are secondary data are Court Decisions, Ministerial Regulations and Data using qualitative documents and analysis. Based on the research concluded: 1) The application of penalties for embezzlement carried out by debt collectors on bank funds in cases No: 104 / Pid.B / 2014 / PN.Lmg) only provides imprisonment for 1 (one) year 3 (three) months to the defendant was more than a prosecutor for 2 (two) years imprisonment, 2) consideration of the judge for embezzlement carried out by a debt collector of bank funds in case No: 104 / Pid.B / 2014 / PN. Lgg) in accordance with juridical and non-juridical considerations, the judge agreed with the dying that the Prosecutor gave in Article 374 in conjunction with Article 64 (1) of the Criminal Code.
