Abstract
Revocation of Decree of DIDIKPORA of Agam Regency was carried out because PTUN considered DIDIKPORA of Agam Regency not authorized to carry out the Mutation, based on Article 4 paragraph (1) Government Regulation Number 9 of 2003 concerning the appointment, transfer and dismissal of civil servants, confirmed by PERMENDAGRI Number 120/5935 / SJ concerning acceleration of transfer of functions, where the mutation process should not be carried out during the transfer of authority from the district / city government to the provincial government . Problem Formulation 1) What is the Judge's Consideration in the Discussion of the Decree of the Head of Youth and Sports Education Agam District Number 821.22 / 335 / DIDIKPORA- 2016 About ASN Mutations in Teacher's Functional Position (Judging From Case Number 21 / G / 2016 / PTUN-PADANG). 2) How the Revocation of the Decree of the Head of DIDIKPORA Kabupaten Agam Number 821.22 / 335 / DIDIKPORA-2016 concerning the Mutation of the State Civil Apparatus in the Teacher's Functional Position (Judging from Case Number 21 / G / 2016 / PTUN-PADANG). The research method used is the Normative Law research or library research that examines the study of documents by using various secondary data, court decisions, and the opinions of scholars. Qualitatively analyzed, grouping data according to the problem under study to draw conclusions and then describe it in sentences. Based on the results of the study 1). Judges' consideration in revoking the Decree of the Minister of Education and Culture was because DIDIKPORA was not authorized to make mutations. 2). The revocation of the Decree of DIDIKPORA was carried out by the way the Padang State Administrative Court ordered DIDIKPORA to revoke the decree because the judge granted the request of the applicant.
