KERJASAMA ASEAN DALAM PEMBERANTASAN PENYELUNDUPAN BARANG-BARANG ILLEGAL DITINJAU DARI ASEAN FRAMEWORK AGREEMENT ON THE FACILITATION OF GOODS IN TRANSIT 1998

ABSTRACT

Smuggling illegal items that occur in Indonesia as well as the flow of transit goods and free economy, then established an ASEAN cooperation in the facilitation of goods namely the ASEAN Framework Agreement on the Facilitation of Goods in Transit 1998. This partnership was formed in order to avoid the smuggling of goods flows, such as goods that do not have valid documents or goods that do not have a permission path in a country. Formulation of the problem; 1) how did the role of ASEAN in the eradication of smuggling illegal goods in terms of the ASEAN Framework Agreement on the Facilitation of Goods in Transit 1998? and 2) how does the applicability and constraints faced by ASEAN in eradicating the smuggling of illegal goods? The research method used sociological laws based on primary data and secondary data with data collection techniques interviews and shaped the study of the documents analysed qualitatively. The results of the research; 1) ASEAN in conducting eradication of smuggling illegal goods through the authority of the Directorate General of customs and Excise as an institution that is authorized to supervise and protect the flow of transit goods out of the customs area entered in good export goods or import, 2) Implementation in the form of protection from the Customs and Excise against goods that transit and the barriers are in the form of internal constraints and external constraints such as the lack of a number of human resources in charge, and the terror of the perpetrator the smuggling.
