MEDIASI DALAM PENYELESAIAN PERKARA WANPRESTASI DI PENGADILAN NEGERI KELAS 1A PADANG

Abstract

Of tort lawsuit 14 coming into the class 1A Padang District Court during the year 2017, just one successful tort lawsuit is mediated. As for the problems in this research are: 1) how is the implementation of mediation in the case in State Court tort Class 1A Pasture? 2) what are the obstacles encountered in the completion of mediation on the matter in State Court tort Class 1A Desert?. This type of research were sociological legal research, data sources that are used are composed of primary data and secondary data. The technique of data collection is interviews and study documents. Data analysis with qualitative methods. Research results can be concluded that: 1) the implementation of mediation in State Court tort litigation Class 1A Padang has several stages, namely the stage of pre-production stages of mediation, the mediation process, and final stages mesidiasi. 2) constraints encountered in the completion of mediation in the case in State Court tort Class 1A Padang is the lack of experienced mediators, the absence of ikhtikad both the parties to attend the execution of mediation, as well as the absence of room facilities specifically for the implementation of the mediation so that the working atmosphere is judge rungan not conducive to use for the implementation of the mediation.
