TINJAUAN YURIDIS TENTANG PERBUATAN MELAWAN HUKUM PADA PERKARA PERDATA NOMOR 10/PDT.G/2011/PN.KBR DI PENGADILAN NEGERI KOTO BARU SOLOK

Abstract

The research method used is normative juridical, the data sources used are secondary data, data collection techniques with document study, analyzed by qualitative methods. As for the conclusions of this study: 1) Defendants proven to violate laws that violate the subjective rights of others, because certify high inheritance land without the knowledge and permission of the mamak head of inheritance and the people concerned. 2) Consideration of judges in the Koto Baru District Court and Padang High Court's ruling which stated that it was in accordance with the element of justice, as well as reasons for refusal to seek safekeeping at the Angung Court because the District Court's decision did not violate the law. the plaintiff and the defendant were asked to vacate the case.
