PROSEDUR PENERBITAN SERTIFIKAT HAK ATAS TANAH KARENA HILANG BERDASARKAN PERATURAN PEMERINTAH NOMOR 24 TAHUN 1997 TENTANG PENDAFTARAN TANAH DAN PENERAPANNYA DI KOTA PADANG
Abstract
The status of a land title ownership certificate is very important, given the meaning of the certificate itself which is a valid and strongest evidence of ownership of land rights registered at the Office of the National Land Agency. To ensure the certainty of legal rights and certainty of lost land certificates, a replacement certificate must be issued. The formulation of the problem of this research is: 1) What is the procedure for requesting the issuance of a replacement certificate Because It Is Lost in Padang City? 2) How is the legal status of the certificate lost after the replacement certificate is issued in the city of Padang based on the Government Regulation No. 24 of 1997 concerning Land Registration? The method used is sociological juridical. Based on this research, it can be concluded that, the procedure for issuing a replacement certificate must attach a loss statement from the police, a request letter, the identity of the applicant, and a statement of oath from the applicant before the Head of the Land Office. Once fulfilled, an announcement is made in the mass media for 1 x 30 (thirty) days, if there is no objection within 30 (thirty) days, then the replacement certificate can be issued by the land office, the replacement certificate issued has the same legal status as the land certificate those that are lost before the replacement certificate is issued, while the legal status of the certificate is lost after the replacement certificate is issued, which is no longer valid.
