PELANGGARAN TERHADAP HAK KEKEBALAN DAN KEISTIMEWAAN DIPLOMATIK DITINJAU DARI KONVESI WINA 1961 (STUDI KASUS : PENYELUNDUPAN SENJATA OLEH STAF DIPLOMAT PERANCIS KE TEPI BARAT SUNGAI YORDAN)
Abstract
ABSTRAK
Diplomatic law regulates the right of immunity, and the privilege of diplomatic representation of a country with the aim that foreign representatives can carry out their duties and functions properly and freely, the diplomatic representative is sent by the sending country, the diplomatic representatives also carry out a diplomatic mission which they are obliged to improve and develop friendly relations between the two countries. To facilitate the tasks of diplomatic representatives, they are given special rights. These rights are the right of immunity and privilege. These rights are not only attached to officials or representatives, but also to family members, diplomatic staff. The granting of these rights is based on the principle of reciprocity between countries. Arrangements concerning immunity rights and privileges already exist in the 1961 Vienna Convention. As in the case of March 2018 there has been a case of arrest of the French Diplomatic Staff for the smuggling of dozens of weapons to the West Bank of the Jordan River by Israeli security, but at the 1961 Vienna Convention which stated that representative staff obtain immunity and privileges in the form of Persona non Grata, the rights of the French Representative Staff are revoked. Formulation of the problem: (1) How is the regulation on the immunity rights of a diplomat regulated in the 1961 Vienna Convention? (2) What sanctions can be applied to violators of diplomatic immunity? The research method used is normative research method. Data sources used are secondary data sources. After the data was obtained the author analyzed the data qualitatively. The conclusion of this study is (1) the 1961 Vienna Convention gives the right of immunity and privileges to diplomatic agents with certain restrictions (2) Misuse of diplomatic immunity is a violation of international law.
