Abstract

The Regional Representative Council is an institution in the country within the scope of the Indonesian State Administration system to represent the aspirations of the community in decision making. Issues to be examined in this study were (1) The position of the DPD members of the elements of political parties in terms of Article 22 Paragraph 4 of the Constitution of the Republic of Indonesia Year 1945 (2) What is the duty and function of DPD of the elements of a political party according to Article 22 of Law oF Constitution of the Republic of Indonesia (3) what internal and external factors faced by the Council based on its position on the elements of a political party and what efforts made by DPD in overcoming obstacles / internal and external factors. The method used is a normative research method. Research that is only aimed at written regulations so that this research is very closely related to the library, analyzed qualitatively, the data obtained is not in the form of numbers that do not require a percentage and do not require certain measurements and tabulation of tables. From the discussion, it can be concluded (1) The position of DPD members of the elements of political parties in terms of Article 22 of the Constitution of the Republic of Indonesia in 1945 is the DPD must have an Individual and not permitted from the political parties because DPD is a representative of the People representing the voice of the people (2 ) Regional Representative Council in the bicameral system in Indonesia has not been balanced by the House of Representatives, especially in the function and authority (3) internal and external factors faced by DPD based on its position on the elements of a political party is the weakness of the authority granted by the constitution, even many experts stating that The DPD only has a position as a House of Representative council.Â Keywords: Position, DPD, Political Parties
