TEKNIK INTEROGASI PENYIDIK PADA UNIT PEREMPUAN DAN ANAK POLRESTA PADANG TERHADAP ANAK SEBAGAI PELAKU TINDAK PIDANA CABUL
Abstract
Investigations into children as perpetrators are carried out by the Women's and Children's Services Unit. In examining children as perpetrators, there must be no pressure, children must feel comfortable. This provision is regulated in Article 117 paragraph (1) of Law No. 8 of 1981 juncto Regulation of the Indonesian Police Chief Regulation No. 3 of 2014 concerning Standard Operating Procedures. The formulation of the problem in the study are: 1) What is the interrogation technique of investigators at the Women's and Children's Service Units in Padang City Police Force against children as perpetrators of obscene crimes, 2) What are the obstacles faced by investigators at the Women's and Children's Services Unit in the Resort Police Padang City in conducting interrogation of children as perpetrators of obscene crimes. This study used a socio-legal approach. Data sources used include primary data and secondary data. Data was collected by interview and document study, and then analyzed qualitatively. Research results: 1) Interrogation techniques used by investigators against children who commit crimes, namely investigators must be patient in conducting interrogations, investigators must avoid questions that directly accuse the perpetrator of committing a criminal act, the investigator must make the perpetrator feel comfortable and not depressed when examined or interrogated, and when examining investigators must be in civilian clothes. 2) the obstacles found by investigators in interrogation techniques for children as perpetrators are; there is no special audit room, he does not understand the questioner from the investigator, and the perpetrator's legal advisor often does not attend when the inspection process is carried out.
