ANALISIS KRIMINOLOGIS ORANG TUA KANDUNG SEBAGAI PELAKU PERAMPASAN HAK KEMERDEKAAN TERHADAP ANAK ( STUDI KASUS POLRETA PADANG)
Abstract
ABSTRAK
Criminal acts of deprivation of rights of independence to children are regulated in Article 333 paragraph (1) of the Criminal Code and Article 1 paragraph (2) of Law Number 35 of 2014 concerning child protection. The crime of deprivation of the right of independence carried out by biological parents against the child which resulted in the detention that occurred in the city of Padang. Research problems: 1) what is the factor of the occurrence of parenthood which results in the deprivation of the right to freedom of children? 2) What is the effort to protect children who are victims of the deprivation of the right of independence carried out by parents against their biological children? This study used a socio-legal approach. Data used in the study including primary data and secondary data. Data was collected by interview and document study, and then analyzed qualitatively. Based on the research, it can be concluded: 1) Factors of the occurrence of criminal acts of deprivation of the right to freedom of children by parents are family factors, economic factors, educational factors, and 2) Efforts to protect children from victims of deprivation of freedom of rights committed by parents against biological children are attempts a) preempt, b) repressive efforts, c) preventive efforts, d) coaching efforts carried out by the police.
