KAJIAN YURIDIS KEBERADAAN BADAN PEMBINAAN IDEOLOGI PANCASILA (BPIP) MENURUT PERATURAN PRESIDEN REPUBLIK INDONESIA NOMOR 7 TAHUN 2018 TENTANG PEMBINAAN IDEOLOGI PANCASILA

Abstract

The existence of the Pancasila Ideology Development Board which was formed based on Presidential Regulation of the Republic of Indonesia Number 7 of 2018 concerning the Development of the Pancasila Ideology is a state institution formed by the President in guarding Pancasila values. Formulation of the problem (1). How the Establishment and Position of the Pancasila Ideology Guidance Body was formed based on Presidential Regulation of the Republic of Indonesia Number 7 of 2018 concerning the Development of Pancasila (2) What are the legal consequences of implementing the Pancasila Ideology Guidance Board. (3). What is the urgency of establishing the Pancasila Ideology Development Board. The method used in this study is a normative legal research method using data sources consisting of Primary Legal Materials, Secondary Legal Materials, and Tertiary Legal Materials using qualitative data analysis. The results of the research are (1) BPIP institutions are legitimate state institutions and have the power the law remains as long as the presidential regulation on which it is formed is still valid and does not conflict with other statutory regulations. (2) BPIP is formed by the President based on Presidential Regulation No. 7 of 2018 concerning the Development of the Ideology of Pancasila which has legal consequences in carrying out its duties and functions. In its implementation BPIP has an organizational structure based on Article 5 of Presidential Regulation No. 7 of 2018 concerning the Development of the Ideology of Pancasila (3) The urgency of establishing BPIP is motivated by preventive efforts from the government towards anti-Pancasila behaviors. But the government through this institution interpreted the Pancasila as incomplete which only focused on the ideology even though there were other values carried by the Pancasila.
