PENDAFTARAN JAMINAN FIDUSIA SECARA DARING (ONLINE) OLEH PERUSAHAAN PEMBIAYAAN MELALUI KANTOR NOTARIS (STUDI KASUS NOTARIS ANDIKA, S.H., M.Kn, Padang)
Abstract
Fiduciary Guarantee is the transfer of the rights of an object where ownership rights are still in the power of the owner of the object. Fiduciary collateral is used to build a debt. Therefore the Fiduciary Guarantee needs to be registered, so that the object is clearly positioned as a fiduciary guarantee. The problems raised in this thesis are: (1) How is the implementation of fiduciary guarantee registration in Padang? (2) What is the cause of the large number of finance companies not registering fiduciary guarantees? (3) What are the Regional Office of the Ministry of Justice and Human Rights in West Sumatra in increasing fiduciary guarantee registration. This study uses a type of sociological juridical research. The data used include primary and secondary data. Data collection techniques in the form of interviews and document studies. Data were analyzed qualitatively. From the results of the study showed that, (1) registration of fiduciary collateral has been carried out by the Bank, but the finance company is still lacking. (2) there are several reasons for financing companies, namely, loosening of peratun, ambiguity of regulations and cost factors. (3) efforts made by the Regional Office of the Ministry of West Sumatra are to provide counseling to related parties.
