PEMENUHAN HAK PILIH BAGI PENYANDANG DISABILITAS MENTAL OLEH KOMISI PEMILIHAN UMUM DI KOTA PADANG MENURUT UNDANG-UNDANG NOMOR 7 TAHUN 2017 TENTANG PEMILIHAN UMUM
Abstract
Article 5 of Law Number 7 Year 2017 concerning General Elections states that "Persons with disabilities who meet the requirements have the same opportunity as voters, as candidates for DPR, DPD, DPRD, Presidential and Vice President Candidates as well as organizers of the General Election". This is the implementation of the government, especially the General Election Commission to fulfill the suffrage which is owned by persons with disabilities including mental disabilities. The formulation of the problem that the author will discuss in this study is (1) How the implementation of the fulfillment of the right to vote for people with mental disabilities according to law number 7 of 2017 concerning elections (2) What are the obstacles faced by the election commission in implementing the fulfillment of the right to vote for persons with mental disabilities (3) What is the effort of the Padang city general election commission in overcoming obstacles to the exercise of the fulfillment of the suffrage for people with mental disabilities. The research method that I use is a sociological legal research method. Based on the results of research conducted by the author, it was concluded that 1). In the implementation of the fulfillment of the right to vote for people with disabilities by the General Election Commission to make efforts (1) data collection, (2) socialization, and (3) provide access. 2). The obstacles faced by the Election Commission include (1) the difficulty of obtaining exact data on families with mental disabilities members, (2) the lack of understanding of the executive officers regarding the voting rights held by persons with mental disabilities, (3) inaccurate voter data a mental disability that uses their right to vote. 3). The efforts of the Padang City Election Commission in overcoming these obstacles are (1) preparing types and quantities of logistics, (2) providing technical guidance to officers, (3) providing circular letters to polling officers.Keyword:fulfillment, suffrage, disability, mentalityReferences
