TANGGUNG JAWAB PENJUAL TERHADAP PERJANJIAN JUAL BELI TELEPON GENGGAM DALAM HAL ADANYA CACAT TERSEMBUNYI (STUDI KASUS SUMBAR SMARTPHONE PADANG)

Abstract

The author is interested in this title, because the author often hears complaints from some people about the services provided by the West Sumatra Smartphone shop. Often consumers get used cell phones containing hidden defects that are not in accordance with the agreement of the parties so that consumers feel disadvantaged. The formulation of the problem proposed is: How is the legal protection of consumers in goods containing hidden defects ?; What is the responsibility of Sumbar Smartphone if hidden defects occur? This study aims to determine the condition of consumer protection for the responsibility of the West Sumatra Smartphone shop to its consumers. This research was conducted by interviewing the West Sumatra Smartphone shop and consumers who feel disadvantaged. Research results obtained from the field are processed through qualitative descriptive methods. The results of this study indicate the weak legal protection for consumers against consumer rights as regulated by Law No.8 of 1999 concerning Consumer Protection, so that in practice these rights are still ignored by the West Sumatra Smartphone shop. The implementation of merchandise responsibilities still does not comply with applicable laws and regulations because the West Sumatra Smartphone shop does not want to be held responsible if its cellphone contains a hidden defect. There are several things that become suggestions, among others, consumers must be more critical to ask the condition of the goods to be bought. Business actors must be able to carry out their responsibilities as they should.
