ANALISIS YURIDIS PENANGGULANGAN KABUT ASAP DITINJAU DARI ASEAN AGREEMENT ON TRANSBOUNDARY HAZE POLLUTIONDIINDONESIA

Abstract

ABSTRACT

Forest and land fires not only cause losses to the country of origin of the fire, but also affect other countries in the form of cross-border smoke pollution. Cross-border smoke pollution has received special attention from ASEAN so that cooperation in the form of Memorandum of Understanding (MoU) between ASEAN members, namely the ASEAN Agreement on Transboundary Haze Pollution. The problem statement is 1) How is the Management of Haze Pollution Management Based on the Asean Agreement On Transboundary Haze Pollution? 2) What is the implementation of the Haze Pollution ASEAN Agreement on Transboundary on forest fires in Riau Province? The method used in this study is normative legal research or library research using secondary data consisting of primary, secondary and tertiary legal materials and document study data collection techniques whose data are analyzed qualitatively. The results of the study are regulated smog control in accordance with Law number 32 of 2009 concerning Protection and Management of the Environment, Law number 41 of 1999 concerning forestry and MoU between ASEAN members better known as the ASEAN Agreement on Transboundary Haze Pollution and several strategies -Special strategies carried out by the government so that forest and land fires do not occur again in the territory of Indonesia. Whereas in the implementation of the ASEAN Agreement on Transboundary Haze Pollution agreement ratified by Law No. 26 of 2014 to become a reference so that in the future there will be no more forest and land fires in the territory of Indonesia.
