PENYIDIKAN OLEH KEPOLISIAN RESOR BUNGO TERHADAP TINDAK PIDANA PENIPUAN BERBASIS ONLINE
Abstract
ABSTRACT
Online-based fraud is an act that violates the law, which is regulated in Article 28 Paragraph (1) of Law Number 16 of 2016 amending Law Number 11 of 2008 concerning Electronic Transactions. Investigators from the Bungo District Police have investigated, AP as a perpetrator who committed goods fraud online by offering goods in the form of clothing and electronics to FH victims in social media networks. Formulation of the problems are (1) How is the investigation conducted by the Bungo District Police regarding online-based fraud? (2) What are the obstacles encountered by the MuaraBungo District Police in investigating online-based fraud? This type of research was socio-legal juridical research. Data sources were primary data and secondary data, data collection techniques are interviews and document studies. Data were analyzed qualitatively. Summary of research results are (1) Investigations are carried out through the stages of arrest, detention, investigation, search and seizure. (2) Barriers encountered by investigators due to internal factors are a lack of human resources and the external community does not report and is more profitable to shop online
