ABSTRACT

In the armed conflict in Syria, Russia carried out a massive attack on the Aleppo region and several cities that were the basis of opposition groups and refugees by using the cluster bomb in 2016. In International Humanitarian Law states that the use of cluster bombs is prohibited in warfare. To find out these conditions, the researcher formulated the problem in two problem formulations, first how is the regulation of international humanitarian law towards the use of cluster bombs. Second, whether the use of cluster bombs by the warring party in syria is in accordance with the provisions of international humanitarian law. The research method used in this writing is a normative research method. This study uses primary, secondary and tertiary legal materials. The data sources of this research are literature, and the internet, then analyzed. From this analysis, it can be seen that the regulation of the prohibition on using the cluster bomb internationally is regulated in the Hague Convention IV 1907 regarding the limited use of means or equipment. The Geneva Conventions of 1949 concerning the protection of civilians during the war. Additional Protocol I of 1977, and 2008 Convention on Cluster Munitions. The attack carried out by Russia was not in accordance with the rules of international humanitarian law.
