PERLINDUNGAN HUKUM TERHADAP NASABAH ASURANSI PASCA KEPAILITAN PERUSAHAAN ASURANSI JIWA BUMI ASIH JAYA

Abstract

In life insurance, the guarantor's obligation is to pay a sum of money as agreed. But in practice PT Asuransi Jiwa Bumi Asih Jaya did not carry out its obligations, so the company was declared bankrupt. Problem formulation is 1) How is the effort to settle the customer's assets towards PT Asuransi Jiwa Bumi Asih Jaya Company which is declared bankrupt? 2) What are the obstacles of the curator in dealing with the bankruptcy of assets? 3) What is the impact of PT Asuransi Jiwa Bumi Asih Jaya's Bankruptcy on the customers? This type of research is sociological juridical. Data sources include primary data and secondary data. Data collection techniques are interviews. Data analyzed qualitatively. Conclusions of the results of the study 1) Settlement of the customer's assets of PT. Bumi Asih Jaya Life Insurance has reached the final settlement stage, namely compiling a list of debts and bankruptcy assets 2) Obstacles in settling the settlement, namely the arrest of the curator, new losses, the slow registration of policyholders. 3) The impact experienced by customers is the distribution of rights that have not yet been distributed.
