PERCERAIAN BAGI MASYARAKAT NON MUSLIM DI PENGADILAN NEGERI PADANG KELAS 1 A

Abstract

Article 38 of the Marriage Act gives the possibility to divorce, but in the Khatolic religion does not give a chance for divorce. But in practice there are still 17 people of Khatolic religion filing a divorce lawsuit into court. The problem formulation is 1) What are the reasons for plaintiff filing a divorce lawsuit? 2) What is the judge's consideration in deciding divorce? This type of research is normative juridical. Sources of legal material include secondary legal materials consisting of primary, secondary, tertiary legal substances.The technique of collecting legal materials is document study. Conclusion of research Results 1) There are 10 people who file a divorce on the grounds of a continuous quarrel, there are 3 people committing adultery/drunkard/gambler, 3 people leave the couple two years in a row, 2 people do cruelty or severe persecution. 2) Judgment of the judge in disconnecting the divorce only by looking at evidence, both proof of letter and witness evidence. Of all the instruments of evidence in this case, the judge's consideration in dropping the verdict in general is due to the occurrence of a continuous quarrel that will not only add to the suffering of the spouse but also to his children.
