GANTI RUGI TERHADAP TUNTUTAN KONSUMEN KEPADA PELAKU USAHA ATAS PRODUK ELEKTRONIK TANPA KARTU JAMINAN
Abstract
Businessman when selling electronic product must be accompanied by a guarantee card after consumers buy some item like in accordance with the Article 25 of the Act Number 8 of 1999 About Consumers Protection. The guarantee card aims to guarantee the item if someday get damaged during the warranty period. But on Cipta Radio Store , the granting of the guarantee card was not carried out, so the rights of the consumer were not fulfilled. And the formulation of the problem is (1) What the reason of businessman not give guarantee card after selling electronic products at Cipta Radio Store in Padang City? (2) How the implementation of compensation by businessman to consumers who are harmed by electronic products without a warranty card on Cipta Radio Store in Padang City?. Type of research is sociological. Collection data by interview. Analyzed data with qualitative. And the result of this research is (1) The reason of businessman is he sell some goods that have a good quality and durable, so the businessman believe that the goods lasts longer than the warranty period, and not required to be given a guarantee card after sale. (2) The compensation from businessman to consumers without guarantee card is service the goods base on damage, refund and replacement of the same items if the consumers have a guarantee card after purchase.
