ABSTRACT
Article 18 B The Constitution 1945 acknowledges, respects and guarantees the enforcement of customary law, the practice of criminal acts of theft in Simatalu village solved by customary criminal law, effective to prevent the occurrence of criminal acts of theft, but Customary criminal law is not written or uncodified. The formulation of the problem is (1) How the customary evidence of perpetrators of theft of indigenous peoples in Simatalu village of West Siberut district of Mentawai Islands, (2) is the basis of consideration of customary leaders in the rationing of sanctions Criminal customary against the perpetrator of theft at the indigenous peoples of Simatalu village in West Siberut district of Mentawai Islands. This type of research is sociological juridical, primary data source and secondary data, interview data collection techniques and document studies, qualitative data analysis. The conclusion is (1) The evidence starts from the reporting of victims, and then indigenous leaders encounter and interrogate suspected strong people as perpetrators, looking for witnesses and evidences that are then locked up (Masipagobuiji) by customary leaders decided to Determining the guilty or absence of a person, (2) The basis of the consideration of customary leaders is basic consideration of basic and additional considerations.
