PERSEPSI DOKTER DI KOTA PADANG TENTANG HAK ABORSI BAGI KORBAN PEMERKOSAAN

Abstract

ABSTRAK

 

Abortion provocatus which is known in Indonesia as abortion comes from Latin which means abortion due to intentional. Abortion arrangements based on positive law in force in Indonesia are contained in Article 346 of the Criminal Code and Article 75 of Law Number 36 Year 2009 concerning Health. Abortion is a fact that makes a serious problem for the community. The issue of abortion is a controversial issue, especially for those who associate such moral values with the attitude of the law that views abortion as a crime. Formulation of the problem of this research: 1. What is the perception of doctors in Padang about abortion rights for rape victims. 2. What is the perception of doctors in the city of Padang about legal protection for rape victims. This study uses a sociological juridical approach. Conclusions: 1. Abortion should only be performed if there are indications of medical emergencies. 2. Doctors as medical personnel are prohibited from carrying out abortions to anyone and anywhere, because every doctor has been sworn in before carrying out his profession as a doctor, and every doctor respects human life, both from the stage of conception to the process of giving birth.
