Abstract
ABSTRACT
Corruption is regulated in Article 2 of Law Number 31 of 1999 concerning Eradication of Corruption. In case No. 27 / Pid.Sus / TPK / 2016. / PN.Pdg ESP defendant as PPAT who has been appointed to make a certificate of release of rights in land acquisition activities for the construction of Campus III IAIN Imam Bonjol has committed a crime of corruption, the judge sentenced him to 4 years in prison and a fine of Rp. 200,000,000.00 (two hundred million rupias) provided that if the fine is not paid it will be replaced with a 2 years confinement sentence. Formulation of the problem 1. How is the application of crime in case No. 27 / Pid.Sus / TPK / 2016. / PN.Pdg? 2. What is the judge's consideration in case No. 27 / Pid.Sus / TPK / 2016. / PN.Pdg ?. This research uses a normative juridical approach. Data sources in the form of secondary data consisting of primary, secondary and tertiary legal materials, data collection techniques through the study of documents and data analyzed qualitatively. Conclusions of the research result: 1. The defendant's actions have fulfilled the elements contained in Article 2 paragraph (1). 2. Judge's consideration in this case consists of judicial consideration including the indictment of the public prosecutor, prosecutor’s demands, evidence, as well as non-juridical considerations.
