ANALISIS YURIDIS TENTANG SENGKETA IMPOR DAGING AYAM ANTARA BRAZIL DAN INDONESIA TAHUN 2014 MELALUIDISPUTE SETTLEMENT BODY (DSB)WORLD TRADE ORGANIZATION (WTO)

After the establishment of the Dispute Settlement Body (DSB) under the auspices of the World Trade Organization (WTO) which handles cases of world trade disputes, it becomes a spotlight for its member countries to settle cases of international trade disputes. by Indonesia with case number DS 484. Formulation of the reviewing problem 1) What is the mechanism for the resolution of the chicken meat impo dispute between Brazil and Indonesia? 2) How is the juridical analysis of chicken meat import dispute between Brazil and Indonesia ?. The method used for writing this article uses the normative legal research method with secondary data which includes primary legal materials, secondary legal materials, and tertiary legal materials. Results of the study 1) The mechanism for dispute resolution in the WTO DSB consists of Consultations, Panels, Appelate Body, Appeals, Recommendations. the dispute hearing between Brazil and Indonesia proceeded to the stage of the Surveillance of Implementation, 2) With the results of the WTO decision, Indonesia decided not to appeal the verdict issued by the DSB, in which the trial was won by Brazil with 4 (four) provisions that conflicted with WTO provisions, namely a positive list, requirements for the use of imported products, import licensing procedures, postponement of approval of veterinary health certificates, but in the decision caused a change in Indonesian national law that is changing the halal provisions written in the Minister of Trade Regulation, and in that decision Indonesia negotiated with Brazil made a more favorable agreement for both parties. So that at this time chicken meat and Brazilian chicken products can enter the Indonesian market.
