PERTIMBANGAN HAKIM TERHADAP PELAKU TINDAK PIDANA PENELANTARAN DI LINGKUNGAN RUMAH TANGGA (Studi Perkara Nomor 554/Pid.Sus/2018/PN.Pdg)

Violence in the form of neglect of households according to article 1 number 1 of the Law of the Republic of Indonesia Number 23 of 2004 concerning the Elimination of Domestic Violence says every act against a person, especially women, which results in physical, sexual, psychological misery or neglect of the household including threats to carry out acts, coercion, or deprivation of liberty unlawfully within the scope of the household. In the case ruling Number 554 / Pid.Sus / PN.Pdg regulated in Article 49 letter a of the 1945 Constitution of the Republic of Indonesia concerning the Elimination of Domestic Violence. Issues examined: (1) How is the application of a crime against an offender in a domestic environment in case Number 554 / Pid.Sus / 2018 / PN Pdg? (2) What is the judge's consideration of an offender in a household case Number 554 / Pid.Sus / 2018 / PN.Pdg. This research method uses juridical-normative research. Data source is secondary data. Data collection technique is the study of documents. Data were analyzed qualitatively. Conclusions of the results of this study: (1) Criminal application in the household environment in case Number 554 / Pid.Sus / 2018 / PN.Pdg imprisoned for 6 months (2) In judges' consideration juridically consists of witness statements, defendant statements, and in the judge's judgment non-juridically consists of things that incriminate and alleviate, the condition of the defendant.
