PENGATURAN PERDAGANGAN ONLINE BERDASARKAN UNCITRAL ( UNITED NATION COMMISSION ON INTERNATIONAL TRADE LAW) 1985 DAN IMPLEMENTASINYA DI INDONESIA

Government Regulation Number 82 of 2012 concerning the Implementation of Electronic Transactions and Systems also regulates Electronic Transactions. Alibaba.com who bought plastic pellets turned out to get garbage when receiving goods in Hong Kong, online transactions were carried out through the Alibaba.com buying and selling site, and the perpetrators of fraud were Steven Freddy, Obetnego and Endang Kurnia. They were reported by a Hong Kong company because they claimed to be a plastic seed seller. (1) What are the online trading arrangements according to UNCITRAL? (2) How is the implementation of online trade in Indonesia ?. In this study the authors used a type of normative research with secondary data including primary legal materials, secondary legal materials, tertiary legal materials data collection techniques with document studies that analyzed data qualitatively. Conclusions of the results of the research: (1) Indonesian Legislation which is a reference for the implementation of electronic commerce is Law Number 19 of 2016 concerning Amendment of Law Number 11 of 2008 concerning Information and Electronic Transactions (ITE) The ITE Law states that electronic transactions can be carried out in the scope of public or private, as written in Article 17 paragraph (1). UNCITRAL is one of the international organizations that first began to discuss the development of information technology and its impact on electronic commerce within the scope of international trade law. The results of UNCITRAL in the form of a law model which are not binding, but become a reference or model for countries to adopt or implement them in national law. (2) The trade mechanism in general, electronic commerce, which becomes the point of differentiation at that point is the communication media in forming trade agreements in the electronic trading system. A significant difference can be seen when there is no physical contact between parties. Year after year electronic commerce can not be underestimated. The growth in the value of online business sales continues to increase every year.
