PERLINDUNGAN HUKUM TERHADAP TENAGA KERJA OUTSOURCING DITINJAU DARI UNDANG-UNDANG NOMOR 13 TAHUN 2003 TENTANG KETENAGAKERJAAN DAN PENERAPANNYA DI PT. SEMEN PADANG
Abstract
ABSTRACT There are many discrepancies in the application of existing rules for outsourcing workers in PT. Semen Padang, West Sumatra since the change of authority over the company, which is now taken over by the central company or Semen Indonesia. Legal protection for outsourced workers is regulated in Act Number 13 of 2003 concerning Manpower. The formulation of the problem: (1) How the legal protection of outsourced workers is reviewed from Law Number 13 of 2003 concerning Manpower and its employment in PT. Semen Padang. (2) What are the problems faced by PT. Semen Padang in providing legal protection for outsourced workers. (3) What are the efforts in providing legal protection for outsourced workers by PT. Semen Padang. The method of this research is sociological juridical. Data sources used are primary and secondary data. Data collection techniques are interviews and document study. Data analyzed qualitatively. Conclusions of the results of the study: (1) Legal protection for outsourced workers can be said to be non-existent, because after work they do not get severance pay, years of service or compensation money and they can be dismissed from time to time. (2) PT. Semen Padang is no longer a corporate corporation so that the wage problem has been transferred to the financial directorate at the center.
