ABSTRACT

PT. PELINDO II for damage to goods in the loading and unloading process is regulated in Article 468 of the Commercial Law (KUHD). Examples of cases of damage to goods in the implementation of loading and unloading are 2 cases in 2016, 2 cases in 2017, 1 case in 2018 and 0 cases in 2019. Formulation of the problem: (1) What are the responsibilities of PT. PELINDO II to damage to goods in the loading and unloading? (2) What are the obstacles in implementing the responsibilities of PT. PELINDO II to damage to loading and unloading goods? This research uses sociological juridical research type. Data sources used are primary data and secondary data. Data collection techniques were carried out by interview and document study. Data were analyzed qualitatively. Conclusions of the study: (1) Responsibilities of PT. PELINDO II against damage to goods in the loading and unloading process, namely by accepting claims from the owner of the goods and replacing damaged or lost items with an amount of money equivalent to the price of the goods. (2) Constraints faced in implementing the responsibilities of PT. PELINDO II to damage to goods in the loading and unloading activities, namely natural factors, human resources (HR), loading and unloading equipment, condition of goods, delays in land transportation, and security.
