PELAKSANAAN PEMBINAAN TERPIDANA BERSYARAT PADA BALAI PEMASYARAKATAN KLAS I PADANG

Abstract

Guidance for the convict is regulated in the Law of the Republic of Indonesia Number 12 of 1995 concerning Corrections. Several activities for the coaching of conditional convicts are conducting special supervision with guidance carried out by Bapas in the form of home visits or visiting clients' homes directly, in addition to the home visits of guidance given by Bapas (Correctional Centers) also in the form of work distribution. Problem Formulation: 1) How is the implementation of coaching for conditional convicts at the Class I Correctional Center in Padang? 2) What are the factors that hinder the implementation of guidance for conditional convicts at the Class I Correctional Center in Padang? In this study the authors used a sociological legal research type. The data sources used are primary data and secondary data. The data collection technique was done by interview and document study, the data were analyzed qualitatively. The conclusions of the research results: 1) The implementation of guidance for conditional convicts that can be carried out by Bapas is to carry out special supervision of clients of conditional convicts by means of home visits, also in the form of channeling work in collaboration with other agencies such as the social department and the manpower department. 2) The inhibiting factor for Bapas in conducting coaching the conditional convict is the opinion of the conditional convicted client, that he considers the conditional sentence to be an acquittal, so that the conditional convicted client feels no need to carry out guidance.
