PERLINDUNGAN HUKUM TERHADAP KURA-KURA MONCONG BABI SEBAGAI SATWA LANGKA MENURUT KONVENSI CITES 1975

Abstract

In Indonesia, the pig-nosed turtle is an animal from Papua that is hunted in its natural habitat, traded, and even abroad. The pig-nosed turtle is an endemic animal from the southern region of Papua which is included in the 21 species that are legally traded. 1) How legal protection for pig nosed turtles as endangered species that are protected according to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES)? 2.) How is the implementation in the trade of endangered species in Indonesia, especially pig-nosed turtles? Juridical normative research method, with secondary data consisting of primary, secondary and tertiary legal materials. Data collection techniques study documents, data are analyzed qualitatively. Research results. 1. The legal protection for the pig-nosed turtle as an endangered species that is protected according to the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) is with the provisions of Appendix II and Law No. 5 of 1990 concerning Conservation of Living Natural Resources and its ecosystem and government regulation number 7 of 1999 regarding the preservation of plant and animal species, IUCN stipulates that these species are included in Endangered protection. 2.Implementation in the trade of endangered species in Indonesia, especially pig-nosed turtles, is subject to the CITES provisions that trade in animals that are threatened with extinction may not be traded without having a valid permit in accordance with the CITES Appendix. This provision has actually been implemented in Law Number 05 of 1990 concerning the Conservation of Living Natural Resources and Their Ecosystems in the context of animal trade in Indonesia.
