PERLINDUNGAN HUKUM BAGI PEREMPUAN DALAM PERKAWINAN TERHADAP IMPLEMENTASI UNDANG-UNDANG NO.23 TAHUN 2004 TENTANG PENGHAPUSAN KDRT DI NAGARI LIMA KAUM KABUPATEN TANAH DATAR

Abstract

Law No.1 of 1974 concerning marriage states that equal rights of husband and wife and the position of husband and wife are equal. But now in reality the position between husband and wife is not balanced because many husbands think their wives must submit to and obey their husbands, resulting in discrimination against their wives, so that it can lead to violent behavior. The problems in this study are:(1) How this implementation of Law No.23 of 2004 concerning the Elimination of Domestic Violence against legal protection for women in marriage in Lima Kaum? (2) What are the inhibiting factors and efforts to implement Law No.23 of 2004 concerning the Elimination of Domestic Violence against legal protection for women in Lima Kaum? This research uses sociological juridical legal methods, data collection techniques used are interviews and document study. This research is descriptive, so the data analysis used is qualitative analysis of primary data and secondary data. From the results of the research (1) the UU- PKDRT Law has been implemented but has not gone well (2) With the inhibiting factor of the implementation of the UU-PKDRT, legal protection for women in marriage is also hampered.
