PENJATUHAN PIDANA TERHADAP TINDAK PIDANA PENGEDARAN OBAT ILEGAL DI APOTIK (STUDI KASUS NOMOR 148/Pid.sus/2015/PN.Pnm)

Abstract

This study aims to determine the criminal charges against the perpetrators of illegal drug trafficking. regulated in Law number 36 of 2009 concerning Health. The research objective is to find out the judge's consideration in imposing a crime on the perpetrator of the illegal drug trafficking. the data used is limited to secondary data, the data is collected by document study, the data collected is analyzed qualitatively. The results of the study show that the criminal charges against the perpetrators of the illegal drug trafficking are convicted. As in the criminal case number: 148 / Pid.sus / 2015 / PN.Pnm. The judge sentenced him to imprisonment for 8 (eight) months and a fine of Rp. 3,000,000, -, a subsidiary of 1 (one) month imprisonment.
