PENEGAKAN HUKUM OLEH PETUGAS KARANTINA BANDARA INTERNASIONAL MINANGKABAU TERHADAP TINDAK PIDANA PENYELUDUPAN MEMASUKAN SUMBERDAYA IKAN YANG MEMBAHAYAKAN SUMBERDAYAIKAN DI WILAYAH PERAIRAN INDONESIA

Abstract

Damage to fish resources caused by species foreign fishis very disturbing to the community, quarantine centers as control of fisheries quality in Indonesia are regulated in Law Number 45 of 2009 concerning fisheries is carried out by the Quarantine agency as stated in Article 10 of Law Number 16 of 1992 concerning Animal, Fish and Plant Quarantine. Problem Formulation 1) How is the law enforcement carried out by the Minangkabau International Airport Quarantine Officer against crimes that endanger fish resources? 2) What are the obstacles faced by the Minangkabau International Airport Fish Quarantine Officer in overcoming crimes that endanger fish resources? This research uses sociological juridical research. Sources of data consist of primary data and secondary data. Data were collected by interview and document study. The collected data were analyzed qualitatively. Conclusion of research results 1) What has been done by quarantine officers in overcoming and eradicating criminal acts against fish at the Minangkabau International Airport Quarantine Center are preventive and repressive measures. 2)The failure to enforce criminal law in the field of animal, fish and plant quarantine at the Minangkabau International Airport Quarantine Center is currently due to the absence of synchronization, coordination and harmony in both structural, cultural and substance aspects.
