TINJAUAN YURIDIS MENGENAI PEMUTUSAN HUBUNGAN KERJA (PHK) SEPIHAK TERHADAP GURU HONOR DI KOTA PADANG STUDI KASUS

Abstract

The problem of termination of employment by companies is a problem that occurs in developing countries including Indonesia. One of these problems is the unilateral termination of employment by private school owners against Honorary Teachers. Problem Formulation: (1) How is the Legal Protection for Honorary Teachers Who Have Unilateral Termination of Employment based on Decision No. 19 Rev. Sus– Phi/2018/PN. Padang? (2) What is the consideration of the Judge's Decision Regarding Work Rights obtained by Honorary Teachers as a result of Unilateral Termination of Work Based on Decision No. 19 Rev. Sus– Phi/2018/PN. field? This type of research is normative law, the data used are secondary data consisting of primary data, secondary and tertiary data. The data collection technique was done by document study and the data were analyzed qualitatively. Conclusions: (1) According to Law Number 13 of 2003 concerning Manpower, termination of employment may result in the entrepreneur or employer having to pay severance pay and/or gratuity for the period of service and compensation for the rights of the worker or laborer as long as he/she works at the company. (2) Consideration of the Judge's Decision Regarding Work Rights obtained by Honorary Teachers as a result of Unilateral Termination of Work Based on Decision No. 19 Rev. Sus– Phi/2018/PN. Padang Sentenced the Defendant to pay the right to Termination of Work to the Plaintiff in cash and amounting to Rp.34,616.270
