PELAKSANAAN PEMERIKSAAN SAKSI JARAK JAUH DENGAN MENGGUNAKAN VIDIO TELECONFERENCE PADA PERSIDANGAN PERKARA PIDANA DI PENGADILAN NEGERI KELAS IA PADANG

Abstract

ABSTRAK The Covid-19 virus which has changed human habits to anticipate the spread of the virus, one of which is a trial process in the Padang Class District Court. The Supreme Court has issued a circular number 1 of 2020 concerning Guidelines for Implementation of Tasks during the Prevention Period of Corona Virus Disease Disease (Covid-19) by conducting an electronic system including using a video teleconference in the examination of witnesses. This study aims to analyze the process of examining a remote witness using a video teleconference at the trial and constraints found in the process of examining remote witnesses using a video teleconference at the trial in the Class I A Padang District Court. This study uses a sociological approach to juridical and gets data in the form of primary data and secondary data. Data collection techniques were obtained through interviews and document studies were then analyzed descriptively qualitatively. The result of the results of the study, namely the process of examining witnesses with video teleconferencing is almost the same as the direct examination and obstacles in the form of a network that is often cut off, the completeness of the tools of the witness, the use of teleconference facilities in each agency.
