TINDAK PIDANA YANG DITIMBULKAN OLEH RUSUH MASSA DALAM PEMILIHAN UMUM KEPALA DAERAH DI TELUK KUANTAN (Studi Kasus Polres Teluk Kuantan)
Abstract
Express opinions in public has been provided for in the law, these activities must not violate the norms that can cause harm to the public interest. But in fact when the General Election which was followed by protesters, not rarely cause damage. Issues raised from this thesis are (1) How are the police in the execution of criminal acts posed by violent mob at bay during the Teluk Kuantan? (2) How are the constraints faced by the police in dealing with crime caused by the rioting mob at bay in Teluk Kuantan? This study uses a socio-juridical approach. Data used include Primary and Secondary Data. Data were collected through interviews and document research. Data were analyzed qualitatively. Results showed that police efforts in the implementation of criminal acts posed by violent mob during the General Election, namely: (a) preventive and repressive in accordance with SOP and Countermeasures Protap/1/x/2010 about Anarchy. (b) Constraints faced by the police as the protests is the lack of personnel and equipment, at the time of local elections must be on guard and the police should have to add a guard personnel and equipment sufficient to handle the protests.
