PELAKSANAAN PEMBINAAN YANG DILAKUKAN OLEH PETUGAS LEMBAGA PEMASYARAKATAN TERHADAP NARAPIDANA (Studi Kasus: Lembaga Pemasyarakatan Klas IIA Padang)

Abstract

Since the issuance of Law no. 12 of 1995 on Corrections. Implementation guidance is based on Pancasila and the inmates of the 1945 Constitution, because the function of punishment is no longer just a deterrent, but also a rehabilitation and social reintegration, which is called the correctional system. Based on the above reasoning, the authors are interested in doing research with the problem, namely: 1) How does the implementation of development carried out by prison officers against inmates Padang. 2) What are the obstacles in its implementation. 3) Are efforts made to overcome these obstacles. This study uses a socio-juridical approach. Data were collected on primary and secondary data, the data collected by interview, observation and document study, then analyzed qualitatively. From the research, then the conclusion is obtained, namely the implementation of the development is done in accordance with the inmates Law. 31 Year 1999 on Guidance and Counseling correctional inmates. The resistance is excess capacity, not match with the content of Corrections officers, lack of interest for inmates to change, and operational costs. Efforts are being made to overcome these obstacles such as transferring some detainees to the nearest prison, parole granting and using optimum operational costs as needed.
