PERLINDUNGAN HAK ASASI MANUSIA (HAM) TERHADAP TAHANAN PEREMPUAN PADA TAHAP PENYIDIKAN DI POLRESTA PADANG
Abstract
Law.8of 1981is acriminal lawbased onPancasilaandthe 1945Constitution oftheCode ofCriminal Procedure Code, theCriminal Procedure Coderegulatedthe protectionof human rightsof suspects incriminalproceedingsorcriminal justice. Issues raisedbythe studyare: (1) How isthe implementation ofthe protectionof human rights ofwomenprisonersinthe investigation stagein thePadangPolice? (2) whatconstraintsin the implementation ofthe protectionof human rights ofwomenprisonersinthe investigation stagein thePadangPolice? This study is asocio-juridicallaw, the writingis descriptive, the sourceof thedata usedprimary and secondary data. Data collection techniquesusingdocument study, interviews/interviewsandobservation. Analysis ofqualitativedataisused. Based on the resultsof researchanddiscussion, it can be concludedthat: First, the implementation of theprotection of human rightsof female detaineesin theinvestigation stagenolawsthatspecificallyregulatethe Criminal Procedure Codeon the protection ofhuman rightsof womenprisonershuman familyat this stage ofthe investigation, buthis arrestis separatedwithmenmaleandfemaleinvestigatorsaccompanied bythe examination. Second, the constraints faced bytheinvestigatororinvestigatorsmaidthattheyconsideredimproperandblamedbywomenprisoners, especially pridsoners for violating human rights in the investigation stage.
