DISPENSASI PERKAWINAN TERHADAP ANAK DI BAWAH UMUR 19 TAHUN PASCA LAHIRNYA UNDANG-UNDANG NOMOR 16 TAHUN 2019 DI PENGADILAN AGAMA PADANG KELAS I A

Abstract

Article 7 of the Marriage Law states that the minimum age limit for carrying out a marriage is 19 years. However, if the age limit is not met, then the law allows to request a marriage dispensation to the Religious Court. Objectives of the Survey: 1) Find out the reasons for the applicant when applying for a marriage dispensation for children under the age of 19. 2) To find out why the judge granted the request for exemption from marriage to a child under the age of 19. The type of research is sociological juridical. The results of the study: 1) The reasons for applying for a marriage dispensation were because parents were worried about their child's association, because there had been an accident (pregnant out of wedlock), and because of difficult economic conditions. 2) The judge's reason for granting the application for dispensation for marriage is based on the very urgent reason proposed by the applicant, the very urgent reason is not specifically explained by law but in the judge's assessment it is interpreted by parents' concerns about their child's association and accidents (pregnancy out of wedlock). The main purpose of granting a marriage dispensation application is based on the benefit of the child.
