ASPEK PERLINDUNGAN HUKUM TERHADAP PERJANJIAN SEWA MENYEWA SAFE DEPOSIT BOX (SDB) PADA BANK TABUNGAN NEGARA CABANG PADANG

Abstract

Safe Deposit Box according to the Circular Letter of the Financial Services Authority Number 27/SEOJK.03/2016 mentions that the Safe Deposit Box is a service to rent a storage box of goods or securities in a Bank room. The Relationship of the Bank and the Tenant Safe Deposit Box is based on a lease agreement. In the agreement there are standard clauses, so that not all tenants can heed the contents of the agreement. The formulation of the problem in this study is 1) How is the legal protection of customers in the rental agreement renting a Safe Deposit Box (SDB) at the Padang branch of the State Savings Bank? 2) How is the efforts to resolve the default made by the customer in the rental agreement to rent a Safe Deposit Box (SDB) at the Padang branch of the State Savings Bank? The method used is sociological juridical (socio-legal research), with primary data sources and secondary data. Data collection techniques by way of interviews and document studies. Data analysis uses qualitative data analysis. The conclusion of this research proposes that the form of legal protection of consumer bank service users is regulated by Bank Indonesia Regulation No. 22/20/PBI/2020 Article 2 paragraph (1) and (2) on Bank Indonesia Consumer Protection. Efforts to resolve the default made by the customer in the lease agreement renting a Safe Deposit Box is the Bank has the right to open a Safe Deposit Box in the event of a default, which previously the Bank sent a Warning Letter (SP) to the tenant. Safe Deposit Box tenants who make default must reimburse the cost of losses, in the event of loss of tenant keys then replace it using the key security deposit, if the tenant dies then the family appoints an heir to open the Safe Deposit Box then the safe deposit box is closed.
