Abstract

ABSTRACT The sea area is still the preferred and most efficient transportation route for sea transportation and international trade. However, along with the increasing use of the sea, the greater the risk of a dispute over the capture of the MT Tanker Ship. Iranian Horse and MT Tanker. Problems: (1) How are the rights and obligations of foreign ships sailing in the waters of a country according to UNCLOS 1982 and PP 36/2002? (2) How is the juridical analysis of the capture of the MT Tanker Ship. Horse (Iran) and MT. Freya (Panama) reviewed from UNCLOS 1982? Normative juridical research method. Secondary data sources consisting of primary and secondary legal materials and using legal data collection techniques using library research. Data analysis using prescriptive analysis. The conclusion of the problem can be seen that the arrest of the Iranian tanker and the Panamanian tanker was caused by the 1982 UNCLOS violation of ALKI and illegal oil transfers.
