PENJATUHAN PIDANA TERHADAP PENYALAHGUNAAN NARKOTIKA YANG DILAKUKAN OLEH ANGGOTA TNI DI PENGADILAN MILITER 1-03 PADANG (Studi kasus: Putusan No. 108 - K / PM I-03 / AD / XII / 2012 Pada Pengadilan Militer 1-03 Padang)
Abstract
Drug abuse offenses in Indonesia are very worrying. Drug abuse is not limited to civilians but rages on among law enforcement officers also military (TNI). TNI as an institution with the task of national defense has a duty to fortify himself to ward off any threats that may endanger the safety of the nation and the state, including the danger that causes by narcotics offenses will be undertaken by members of the military. The problems of this study are: 1) how does criminal punishment against drug abuse committed by members of the military at the Military Court I-03 Padang? 2) Is the consideration of the judges in criminal punishment against drug abuse committed by members of the military at the Military Court I-03 Padang?. This study uses a normative approach. The material studied is I-03/AD/XII/2012 108-K/PM Court decision. This study uses secondary data. Data were analyzed qualitatively. Based on the results of research are: 1) The decision of the judge in the form of sentences in prison and dismissed from the military service is very incriminating the defendant, at the I-03 Military Court judge dropped criminal Padang is not the same as the other District Court, because the criminal sanctions imposed by the military judge in feel heavier than the District Court. 2) Consideration of the judge in the criminal verdict against narcotics criminals in Military Court I-03, Padang is influenced by the things that burden and ease.
