Abstract

ABSTRACT The crime of falsifying authentic deeds is regulated in Article 264 Paragraph (1) of the Criminal Code number 1 of the Criminal Code in conjunction with Article 55 paragraph (1) number 1 of the Criminal Code. The crime that occurred in Case Number 278/Pid.B/2020/PN.SD. Research Objectives: 1) To analyze the accountability of the Notary who commits the crime of falsifying authentic deeds in the case of decision number 278/Pid.B/2020/PN.SDA. 2) To analyze the judge's considerations in imposing a crime against a Notary who commits a criminal act of falsifying an authentic deed in the case of decision number 278/Pid.B/2020/PN.SDA. The normative method is the study method used in this study. in this study the data sources used were primary data, secondary data and tertiary data. The data collection technique used a document study and the data were analyzed qualitatively. The conclusions of the research (1) Criminal liability against a Notary is a criminal act, capable of being responsible, an error, no excuse for forgiveness. (2) The judge's considerations consist of juridical considerations are the Public Prosecutor's Indictment, the Public Prosecutor's Claim, Evidence, Evidence. Non-juridical considerations are the background, the consequences of the defendant's actions, the defendant's condition, aggravating and mitigating factors.
