Abstract

ABSTRAK International law must be obeyed by countries around the world in establishing international relations. This is regulated in the NPT (Treaty on the Non-Proliferation of Nuclear Weapons) and the International Atomic Energy Agency (IAEA). North Korea's nuclear weapons test has been criticized by various parties because it is considered an act of provocation and threatens peace and security stability global..Problem formulation: (1) How is the regulation regarding the prohibition of the use of nuclear weapons according to international law?; (2) How is the juridical analysis of the prohibition of nuclear weapons tests carried out by North Korea? The research uses normative legal research. The data sources used are the data secondary law consisting of primary, secondary, and tertiary legal materials. Data collection techniques used document studies and the data were analyzed qualitatively. Nuclear Weapons / NPT (Nuclear Non-Proliferation Treaty) is against with customary international law, and which includes the UN Charter, UN General Assembly Resolutions, UN Security Council Resolutions, and the IAEA Statute which has been regulated in Article 38 paragraph 1 of the ICJ Statute, as a source of international law; , violating the UN Charter, nuclear weapons testing is an act that has no legality under international law because the act is contrary to Article 1 paragraph 1 and 2 paragraph 4. , in the field of defense; and in the field of international cooperation.
