ANALISIS YURIDIS LARANGAN EKSPOR BIJI NIKEL INDONESIA TERHADAP UNI EROPA DITINJAU DARI GENERAL AGREEMENT ON TARIFFS AND TRADE/WORLD TRADE ORGANIZATION

Abstract

ABSTRACT Based on Article 62A of the Regulation of the Minister of Energy and Mineral Resources of the Republic of Indonesia Number 11 of 2019 concerning Mineral and Coal Mining Concessions that the sale of nickel with a grade of <1.7% abroad remains valid for a maximum of 31 December 2019 and the European Union sues Indonesia to the WTO for Indonesian Government policies. Problem formulation: 1) Does the ban on the export of Indonesian nickel ore to the European Union violate the GATT/WTO provisions?. 2) What is the reason for Indonesia to ban the export of nickel ore to the European Union?. This type of research uses normative legal research. Data sources are secondary data consisting of primary, secondary and tertiary legal materials. Data collection techniques using library research. Data were analyzed using qualitative juridical. Research conclusions 1) The Indonesian government's policy of prohibiting the export of Indonesian nickel ore to the European Union is based on the Regulation of the Minister of Energy and Mineral Resources of the Republic of Indonesia Number 11 of 2019 concerning Mineral and Coal Mining Concessions, this clearly violates the provisions of GATT/WTO at the point of National Treatment . 2) Indonesia's reason for banning nickel ore exports to the European Union is due to the depletion of nickel ore stocks in Indonesia and the reduced production of batteries in Indonesia.
