KAJIAN YURIDIS TERHADAP PERIODESASI MASA JABATAN PRESIDEN DAN WAKIL PRESIDEN DALAM PENYELENGARAAN PEMERINTAHAN DI INDONESIA

Abstract

Restrictions on the term of office of the President and Vice President of the Republic of Indonesia are contained in Article 7 of the 1945 Constitution of the Republic of Indonesia. Limitation of power aims to provide limits to the Government in order to avoid the possibility of abuse of power. The limitation of the president's term of office is carried out to avoid abuse of power and to regenerate leadership. The formulation of the problem in writing this thesis are: (1) How is the regulation of the periodization of the term of office of the President and Vice President in the 1945 Constitution of the Republic of Indonesia before and after the Amendment?, (2) What is the urgency and importance of the term of office of the president and vice president? talk about 3 periods? The research used is normative juridical, the data source used is secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. Data collection techniques using document studies and analyzed qualitatively. The conclusion of this study is that the limitation of the periodization of the term of office of the President and Vice President in Article 7 of the 1945 Constitution of the Republic of Indonesia underwent changes in order to limit the power of the President and avoid authoritarian leadership. developments regarding the discourse on periodization restrictions always appear with urgency to avoid polarization and continuity of development, this is a dynamic of democracy so that it can become the law that is aspired to (ius constituendum).
