Abstract

When consuming herbal medicine, consumers should pay attention that the herbal medicine consumed is accompanied by an explanation in accordance with the laws and regulations. If there are business actors harming consumers who will consume herbal products that they trade, therefore business actors must be responsible for the losses incurred. Problem formulation: (1) What is the responsibility of business actors if the herbal medicine sold is not registered with BPOM and causes losses for consumers? (2) What actions will be taken by BPOM and what efforts will be made by BPOM in eradicating unregistered herbal medicine? This type of research is juridically sociological using primary data and secondary data. Data collection techniques are carried out by interviewing and studying documents and qualitative data analysis. Results from the study: (1) The responsibility of business actors is to provide compensation in the form of refunds, replacement of goods and also the provision of health services. (2) The actions taken by BPOM Padang are by conducting direct or indirect supervision and efforts that will be done by imposing administrative sanctions, extermination or doing sita without compensation.
