PENYELESAIAN PERMOHONAN IZIN POLIGAMI DI PENGADILAN AGAMA PADANG KELAS 1A

Abstract

Article 3 paragraph 2 of the Marriage Law states that the court can give permission to a husband to have more than one wife if the parties concerned want, but not all applications are granted, some are revoked by the applicant and rejected by the judge. The formulation of the problem: 1) What is the reason for the applicant to withdraw the application for a polygamy permit at the Padang Religious Court Class 1A. 2) What is the judge's consideration in granting a polygamy permit at the Padang Religious Court Class 1A. 3) What is the judge's consideration in rejecting the application for a polygamy permit at the Padang Religious Court Class 1A. The type of research is normative juridical, data sources are primary legal materials and secondary legal materials. The collection technique is in the form of document studies which are analyzed qualitatively. The conclusions are that: 1) Whereas the reason for the applicant withdrawing his application is because the applicant's second wife candidate does not want to attend the trial, the applicant receives input from the mediator, the applicant has married his prospective second wife, the applicant's wife has died, the reasons for polygamy are not fulfilled by the applicant. 2) The judge's consideration in granting the polygamy permit application is because the reasons and conditions for polygamy have been fulfilled by the applicant. 3) The judge's consideration in refusing the applicant's polygamy application is because the applicant's reason in accordance with Article 4 of the Marriage Law for polygamy was not proven at trial.
