EFEKTIVITAS PERJANJIAN BAGI HASIL PENGGARAPAN SAWAH DI NAGARI CAMPAGO SELATAN KABUPATEN PADANG PARIAMAN

Abstract

A revenue sharing agreement is a form of agreement made between the land owner and the farmer on the other side. The agreement proceeds of the land is divided according to the balance that has been agreed. As stipulated in Article 2 of Law No. 2 of 1960 concerning The Revenue Sharing Agreement. The problems in this study are: (1) How to implement the share of rice fields in Nagari Campago Selatan Padang Pa-riaman Regency. (2) What are the obstacles and settlement efforts that arise in the implementation of rice field development revenue sharing in Nagari Campago Selatan Padang Pariaman Regency. Types of sociological juridical research, the main data is pri-mer data, interview data collection techniques and document studies, qualitative analysis data. Results of research: (1) In the practice of mampaduoi landowners finance all needs in soil processing with the provision of the revenue share which is 1/2 share for cultivators, and in mampatigoi practices which one the processing costs are borne by the cultivator with the provision of 2/3 part for the rake and 1/3 part for the owner. (2) The constraints found in mampa-duoi are the difficulty of estimating the funds that the owner must provide for cultivators. Obstacles in mampatigoi practices are the costs needed to cultivate rice fields are very high, making it difficult for cultivators. Efforts that are acknowledged: In the practice of mampaduoi cultivators make the cost of processing the land so that the land owner provides costs as needed and in the practice of mampatigoi cultivators must adjust the price of the material with the distribution of proceeds with the owner.
