PERAN POLISI MILITER DALAM PENYIDIKAN TINDAK PIDANA PENADAHAN YANG DILAKUKAN OLEH ANGGOTA TNI ( STUDI KASUS DI DENPOM 1/4 PADANG )

Abstract

Soldier who commit offenses will apply the Code of Military Criminal Law (KUHPM). Investigators who handle crimes committed by the Tni is Military Police. In the city of Padang was found that there is military crime fencing. The problem in this paper are: 1) how does the role of the Military Police in the investigation against members of the military who commit crimes fencing. 2) what are the obstacles facet by military police in soiving criminal cases fencing. This is a descriptive study, the socio-legal approach. Data used include primary data and secondary data, the data collected trough interviews and document study. Data were analized qualitatively. From the results of the study concluded  that: 1) the ole of the Military Police is investigating any criminal incidents that occurred, the function is set on the Military Police Decree No. Kep I/III/2004 TNI commander. 2) constraints faced fenced goods that have been sold or transfereble, it wpuld require an investigation of teamwork in order to get maximum results.
